The method to exclude patch in a scan is the same for Agent and Agentless scans. The 'Applies to Agents' message is information you it also applies to agents.
Create a Patch Group and add the patch to it.
Create a Scan Template and choose this Patch Group as an Exception. The patch will be ignored.
